
If you are a brony, then you heard recently that MLP: Fighting is Magic just got canned because Hasbro sent a cease and desist order to the Mane6 team. I felt pretty bad that that had to happen, especially for such a polished looking game. It had a lot going for it, however, Mane6 made one fatal error that doomed the game, they made it too close to the actual copywritten material. Now, I for one would have loved to splay the game, jhowever, Mane6 approached this all wrong, and I can attribute this to how young this fandom is. What we should have done was look to another fandom...
The transformers fans have always loved some of their older G1 figures, but wish that there were better version or remakes of them. Now, they can only wait on Hasbro to finally make these, or they can make these figures themselves, thus transformers fan projects was born. There are numerous transformers fan projects out there that make grade-A toys based on licensed Hasbro figures, and even sell these figures, something that I'm sure even Hasbro will have a fit over and will be throwing out numerous cease and desist orders everywhere, and yet they don't. These fan projects are still around and making money, and its all because of the round-a-bout way go about making these fan-made figures. These toys are completely new, made from scratch and not based on any existing mold of what the toy is supposed to represent, hell, they even give them names that vaguely represents who they are supposed to be. I've seen a fan-made Devastator toy selling for around $500, and this toy is no joke, the amount of detail and effort put into these things is astounding. And its huge too! Almost 3-4 feet high! I bet even Hasbro would never think to make such a toy, but the fans did, and they will pay out the nose to get them.
Now, what does this have to do with MLP: fighting is magic? Its very simple, the game has to cut its ties with MLP, but not completely. Its still gonna be a game about ponies fighting, but all the characters, any references to the show, has to be changed to all new characters, but will still fight and feel the same way based on who they were originally based on. Twilight Sparkle will get a new name and a new coat of paint like Nightspark or something like that, MLP will have to be changed into something else like Fighting Ponies or Pony fighters or something along that line and all backgrounds will have to be changed to something completely new. Sadly, that would mean no fighting in Sweet Apple Acres, but it must represent, in spirit, what Sweet Apple Acres would be like in that game. Fact of the matter is, Transformer fans and bronies are a lot alike, we make a lot of fan-made stuff all the time, and I think its time we approach this, and all other future fan projects in a similar vein. We have to tread carefully when it comes to playing around with copywritten material, especially if its something that would turn a lot of heads, we just have to make sure we don't turn the wrong heads in our direction.

Compare it to conventions where artists sell prints of their fanart. No one's gonna stop them from doing that (because enforcing it while not impossible would be a logistic nightmare, aside from the orwellian vibes that fanart police on conventions might create), however, selling prints online on a big scale? yeah, damn sure you can't do that. Hell, deviantart itself doesn't allow prints of fanart (for very good reasons)
So, Fighting is Magic has automatically a massive range because it's downloadable thus easier to hit with a CAD.
Also the idea that creating a MLP fighting game with OCs would fly? Nope. On that note, you can't copyright characters only trademark them, so removing the trademark violation from the game characters doesn't remove the copyright violation because the game is still based on the universe which damn sure can be copyright protected.
So having a cast of ponies called Penumbra Shine, Orangejake, Uncommonty, Rose Cake, Flappydemure and Spectrum Sprint won't change the violation of copyright held by Hasbro. Especially since the OC thing could easily be modded into the actual mane six and CADing a mod is difficult to say the least. Just let the implications roll down the tongue: Every fandom OC is essentially illegal but it's too much of a hassle to actually do something about it.
So yeah, by now, Fighting is Magic has to cut its ties with the fandom COMPLETELY to not invoke the wrath of TEH LAWYERS. It might've been different if they started out with OCs during programming but honestly, considering the quality and size of the project, I doubt it because of the aforementioned modding possiblities.
Lauren Faust didn't offer non-MLP original characters for no reason. She's well aware of the bullshit this copyright law is. And frankly after the completely avoidable shit Hasbro pulled, I wouldn't prefer it any other way. Release it with new characters designed by Lauren Faust on Steam and I'll buy the game three times just to show my appreciation.
Also, the claim that hasbro's hands are "tied" in this matter due to some ridiculous "defending your trademark/copyright" loophole the copyright laws have is quite frankly a lie.

The guys behind this crossover didn't use just one but TWO copyrighted sources. Capcom could've sent an CAD order with the blink of an eye but they actually checked it out and endorsed it, generating a RIDICULOUS amount of good press for free. Sure, they got no profit out of it but fans and game creators alike. And no, Capcom did not magically lose copyright over the SF and MM franchises because of it. Why Hasbro didn't do this with Fighting is Magic and MLP Online which seemed to have incredible potential as well is beyond me.
Besides, wouldn't it be awesome if you got a separate MLP series made by Bronies for Bronies as well?
heheh, and that's what the bronies will do! Hasbro won't completely cater to bronies because we are not the target audience, we are the sidebar, however, that won't stop us bronies from making brony stuff. However, we have to tread lightly so as not to cause a scene and get Hasbro down our throats, because we are not their target audience. Like I said, its a frickin' miracle that they actually pandered to us that they did, with collector's edition ponies, comics, our first ever villain for a toy and all those little references and brony shoutouts in the show, commercials and advertisements. Its like stealing jewels from a dragon's horde. Just steal little amounts and the dragon won't notice, but if you steal enough, the dragon will notice and get angry. =3
